Terms and Conditions
1. Application
1.1 These subscription terms and conditions (hereinafter “Terms”) apply to all offers, sales, support agreements, and contracts between Flekaskil ehf. (hereinafter “GODO”) and the customer (hereinafter “Customer”), unless otherwise agreed in writing by the parties. In the event of a conflict between these Terms and any conditions of the Customer, these Terms shall take precedence unless the differing terms have been accepted in writing by both parties.
1.2 It is a prerequisite for entering into agreements between GODO and the Customer that the Customer is a business with its own CVR number. The Customer agrees that GODO may send notifications regarding the agreement via email. The Customer is responsible for ensuring that their contact information—company name, contacts, email address, and postal address—is kept up-to-date.
2. Basis of Agreement
2.1 A specific offer made by GODO is binding for 60 days after it has been made or submitted in writing to the Customer.
2.2 An agreement becomes binding for GODO only once the Customer has received a written order confirmation. An order is recorded at the price valid at the time of GODO’s order confirmation. The Customer must immediately review the order confirmation upon receipt and contact GODO promptly if there are any discrepancies.
3. Subscription Duration and Billing
3.1 The subscription becomes effective upon order and remains active until terminated in accordance with these Terms. The monthly fee is calculated based on the status on the last day of the month (number of units, sales channels). Monthly fees are due on the first working day of the month for the upcoming month. The subscription is paid monthly until terminated, with the first invoice received at the end of the following month.
4. Scope and Usage of Subscription
4.1 The Customer gains a non-exclusive right to use GODO’s systems as per these Terms. The Customer warrants and assumes full responsibility for any third parties to whom the Customer grants access to GODO’s systems.
4.2 Except as provided in 4.1, the Customer is not entitled to transfer the subscription to a third party.
5. Prices and Payment Terms
5.1 GODO reserves the right to correct any errors in offers and order confirmations.
5.2 Payment terms are 14 days net from the invoice date.
5.3 If the invoice is not paid on time, a first reminder will be sent without charge. If the invoice remains unpaid, a second reminder will be sent, with an added fee, according to applicable Icelandic legislation. If payment remains overdue, GODO may block the Customer’s access to its systems, which will be restored upon payment unless GODO has terminated the subscription beforehand. GODO is not liable for any operational losses, loss of profits, or other indirect damages due to restricted access to its systems.
5.4 The Customer agrees that invoices and reminders sent via email to the email address provided by the Customer are considered delivered when dispatched by GODO.
5.5 Price changes will be notified via email. All prices include VAT.
6. Termination
6.1 Subscriptions to GODO’s systems can be terminated in writing at the following email address: info@godo.is. The termination will take effect at the beginning of the next month following the notice.
6.2 GODO may terminate the subscription with 30 days’ written notice at the end of a month or without notice if the Customer materially breaches these Terms or becomes insolvent or bankrupt.
7. Customer’s Data
7.1 The parties agree that the Customer owns and has full discretion over its own data in GODO’s systems as long as the subscription is valid.
7.2 GODO is entitled to retain Customer data after termination, using it in an anonymized form for statistics and analysis.
8. Operational Stability
8.1 GODO strives for maximum operational stability but is not liable for outages or disruptions caused by, among other things, power failures, equipment malfunctions, internet or telephone connection issues, or force majeure events.
8.2 In the event of an outage or disruption, GODO aims to restore normal operation as quickly as possible.
9. Modifications
9.1 GODO is entitled to continuously update and improve software and systems. Such updates, improvements, and changes may occur with or without notice and may affect services, including information and data uploaded to or provided by GODO.
10. Intellectual Property Rights
10.1 With respect to the material uploaded by the Customer and all Customer data, the Customer grants GODO and its suppliers sufficient permission to operate and maintain its systems, fulfill its obligations, and market to the Customer. The Customer warrants that the uploaded material does not infringe on third-party rights.
11. Assignment
11.1 The Customer agrees that GODO is entitled to use subcontractors in all respects, including for the operation and maintenance of systems and software and for storing the Customer’s data.
12. GODO’s Liability
12.1 GODO is not responsible for third-party solutions that are available and/or integrated with its own systems. Consequently, GODO cannot be held liable for the accuracy, quality, or reliability of the information or for the results obtained through these third-party solutions. Similarly, GODO is not liable for the availability, security, or functionality of third-party solutions, including for potential damage and/or losses caused by third-party solutions.
13. Changes to Terms
13.1 GODO is entitled to modify these Terms in any respect. The current Terms will be available on GODO’s website (godo.is). GODO aims to provide reasonable notice in connection with any changes. Use of GODO’s systems after changes to these Terms constitutes acceptance of the amended Terms. The Customer is responsible for staying informed of any changes to the Terms.
14. Confidentiality and Data Security
14.1 GODO is obligated to maintain confidentiality regarding all information it may acquire about the Customer and is not entitled to disclose such information to third parties unless the information is publicly available or GODO is required to disclose it by law or by order of an authority or court.
15. Disputes
15.1 Complaints arising from the subscription must be submitted in writing to info@godo.is.
15.2 In the event of legal disputes under the subscription, the parties agree to negotiate in good faith. If a settlement cannot be reached after one in-person meeting, the dispute shall be resolved under Icelandic law.
16. Validity 16.1 These Terms are valid from 01-01-2021 and replace previous terms.
General Sales Conditions
1. Application
1.1 These sales, support, and delivery conditions apply to all offers, sales, deliveries, support agreements, and other agreements between Flekaskil ehf. (hereinafter referred to as GODO) and the buyer (hereinafter referred to as Buyer), unless otherwise agreed in writing by the Parties. In such cases, the terms in such written agreements shall prevail if they expressly stipulate otherwise than the below sales and delivery conditions.
1.2 In the event of discrepancies between the below sales terms and any of the Buyer’s conditions, these terms shall take precedence unless the differing conditions have been accepted in writing by both Parties.
2. General

2.2 An agreement becomes binding for GODO only once the Customer has received a written order confirmation. The Customer must immediately review the order confirmation upon receipt and contact GODO promptly if it does not match the agreement between the parties. Otherwise, the order confirmation is considered binding with the given content.
3. Prices
3.1 GODO reserves the right, until delivery has taken place, to adjust prices proportionally in the event of an increase in costs related to transport, insurance, fees, exchange rates, or similar factors outside GODO’s control.
3.2 Prices stated in the order confirmation are quoted in Icelandic krona, including VAT.
3.3 If GODO’s costs increase due to the Buyer’s actions, GODO is entitled to claim reimbursement.
3.4 Price changes will be notified via email. Changes that only benefit the Buyer may take effect immediately without notice. All prices include VAT.
4. Product Information
4.1 GODO reserves the right for errors and changes in brochures, website, and other sales materials. Any such errors cannot be claimed against GODO.
4.2 GODO also reserves the right to make design and/or construction changes to the relevant products until the agreed delivery date.
5. Delivery
5.1 GODO is entitled to deliver via a supplier chosen by GODO.
6. Payment
6.1 The monthly fee is calculated based on the status on the last day of the month (number of units, sales channels, etc.).
